Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Tumbler Den website and purchases from Tumbler Den. By using the store or placing an order, you agree to these Terms and the policies incorporated into them. Mandatory consumer rights under applicable law continue to apply.

1. Eligibility and accounts

You must have the legal capacity to enter into a contract in your province or territory. You are responsible for accurate information and for protecting account credentials. Notify us promptly of suspected unauthorized use.

2. Store information and product listings

We aim to describe products, colours, dimensions, compatibility, availability, prices, and images accurately. Screen settings and manufacturing variations can affect appearance. Brand names and trademarks belong to their respective owners and identify genuine branded products offered for resale.

Tumbler Den is an independent retailer. Unless expressly stated and supported, nothing on the store represents sponsorship, endorsement, certification, or affiliation with a product manufacturer or trademark owner.

Availability may change before an order is accepted. We may correct genuine errors, update information, or withdraw a listing.

3. Prices, currency, taxes, and shipping

Prices are displayed in Canadian dollars unless clearly stated otherwise. Applicable taxes and shipping charges are disclosed before payment. Standard shipping within Canada is CAD $10 for orders below CAD $50 and free for orders of CAD $50 or more, calculated after discounts and before tax. Product-specific or promotional terms apply only when clearly disclosed before purchase.

4. Orders and payment

Submitting an order is an offer to purchase. An order is accepted when we confirm acceptance or begin fulfillment, subject to payment authorization, availability, fraud review, delivery restrictions, and these Terms. We may reject or cancel an order for a genuine pricing or listing error, suspected fraud, payment failure, inventory unavailability, delivery restrictions, or a violation of these Terms. If we cancel after payment, the charged amount will be returned to the original payment method.

Payments are processed securely through Shopify and available payment providers. You authorize the charges displayed at checkout.

5. Fulfillment, title, and risk

Products may be fulfilled by Tumbler Den or a Canadian distribution partner, including Randmar.io. Shipping estimates are described in our Shipping Policy. To the extent permitted by law, risk of loss transfers upon delivery to the address supplied at checkout. Nothing in this section limits rights concerning a lost, damaged, defective, or incorrect delivery.

6. Returns, exchanges, refunds, and cancellations

Our Return, Exchange, Refund, and Cancellation Policy forms part of these Terms. It describes the 30-day request window, product-condition requirements, return-by-mail method, prepaid return label, the mandatory 20% restocking fee for approved change-of-mind or customer ordering-error returns, refund timing, exchanges, damaged items, and cancellations.

7. Acceptable use

You may not use the store to violate law; infringe intellectual-property or privacy rights; transmit malicious code; interfere with security or operation; scrape or access systems without authorization; submit false information; commit fraud; or harass another person. We may reasonably restrict access to protect the store, customers, or third parties.

8. Intellectual property

The Tumbler Den name, site design, original text, graphics, and other original content are owned by or licensed to Tumbler Den. They may not be copied or commercially exploited without permission. Third-party trademarks and materials remain the property of their respective owners.

9. Reviews, feedback, and submitted content

You retain ownership of eligible content you submit and grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and use it to operate, improve, and promote the store, subject to our Privacy Policy. You represent that your content is lawful and does not violate another person’s rights.

10. Third-party services and links

The store may use or link to Shopify, payment providers, fulfillment partners, carriers, brand owners, or other third parties. Their services can be governed by separate terms and policies. We are not responsible for websites we do not control.

11. Disclaimers

To the extent permitted by law, the website is provided on an “as available” basis. We do not exclude warranties or remedies that cannot legally be excluded. Product warranties, where available, are subject to their terms and may be provided by the manufacturer.

12. Limitation of liability

To the extent permitted by law, Tumbler Den and its suppliers are not liable for indirect, incidental, special, or consequential losses arising solely from use of the website. This limitation does not apply where prohibited and does not limit liability for fraud, intentional or gross fault, personal injury, or mandatory consumer remedies.

13. Indemnification

Where permitted by law, you agree to indemnify Tumbler Den against third-party claims arising from your unlawful use of the store or a material breach of these Terms. This does not apply to ordinary consumer use and does not reduce mandatory rights.

14. Privacy

Our Privacy Policy explains how personal information is handled and forms part of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of Quebec and the applicable federal laws of Canada, without depriving a consumer of mandatory protections available in their province or territory. A dispute will be submitted to a court with jurisdiction under applicable law. We encourage you to contact us before beginning formal proceedings.

16. Changes, severability, and entire agreement

We may modify these Terms prospectively by publishing a newly dated version. A change does not retroactively alter an accepted order unless required by law or agreed with you. If a provision is unenforceable, the remaining provisions continue. These Terms and incorporated policies constitute the agreement concerning use of the store and purchases.
